Catalogue Description

John Lee was born in Yorkshire in 1733, but for the major part of his life he resided at Malvern House, Staindrop. Having qualified as a barrister he attended the northern circuit for many years and was appointed Recorder of Doncaster in 1769 (D/Bo/C 1). He became Deputy Lieutenant of the West Riding in 1779 and was invited to the Bench by the Council of Lincoln's Inn in 1780 (D/Bo/C 3, 10). This was followed by a series of appointments culminating in his appointment to the office of Attorney-General in the Fox-North coalition government of 1783. At this time Lee was M.P. for Higham Ferrers (Northamptonshire). Although Lee did not retain the Attorney-Generalship for long because of a change in government, he served as Attorney-General of the Durham Palatinate from 1784 (D/Bo/C 8) and his patent was renewed by Bishop Shute Barrington in 1791 (D/Bo/C 9).

Lee was married to Mary Hutchinson, the daughter of Thomas and Tabitha Hutchinson, of Staindrop, and by her had his only daughter and heir, Mary Tabitha Lee who died in 1851 aged 74. John Lee died in 1793 and was interred in Staindrop Church where a fine monument by Nollekins was erected by his widow above the South door. She herself died in 1812, aged 78.

The records of the family were deposited in the Museum by the British Records Association and the most important parts of the collection are the correspondence of John and Mary Lee (D/Bo/C 13-246) and the muniments of title (D/Bo/C 339-581). The correspondence contains numerous letters from well known contemporary figures including General Burgoyne (D/Bo/C 22-27), Joseph Priestley (D/Bo/C 108-110) and the Marquess of Rockingham (D/Bo/C 135-142). The title deeds relate mainly to properties in Barnard Castle and Staindrop, many of which were acquired by Mary Lee's father, Thomas Hutchinson, both by purchase and through his marriage with Tabitha Atkinson. In addition to the correspondence and title deeds, there is a number of grants of office to John Lee (D/Bo/C 1-11), some family papers (D/Bo/C 249-338), enclosure papers (D/Bo/C 584-609) and a few miscellaneous items (D/Bo/C 610-622).

Busk, Wadsworth (Ref: D/Bo/C 28-35)

Attorney-General in the Isle of Man.

Ref: D/Bo/C 28-35

Gross absurdity of corresponding in Persian - "it is forcing him to surrender the nakedness of his Bosom secrets to his religious as well as his political Equerry, equally impolitic for the English as well as for the King of Tanjore himself"; Sir George Wombwell [Chairman of the East India Company] has promised to remedy this; asks for loan of £360 to pay insurance on money due from R of T. [Raja of Tanjore?], London, 19 December 1778 Passage to the Isle of Man; seeks advice about a mortgage; has persuaded House of Keys to settle matters with the Duke of Atholl [John Murray, 4th Duke, son of 3rd Duke, who had sold the sovereignty to the Isle of Man to the Crown in 1765; the 4th Duke sold the property interests and remaining privileges to the Crown also] and House has desired him to apprize Duke of the resolution; enclose a copy of letter to Duke, Isle of Man, 26 September 1781 Letter to Duke of Atholl (enclosure in above); intention of the Tynwald to pass an Act to aid Duke in his recovery of rents and manorial rights, (September 1781) His attempts to remedy a dispute between the Duke of Atholl and the inhabitants of the Isle of Man; ungentlemanly behaviour of the Bishop and Receiver General towards him; action of Dr, Price [Richard Price (1723 - 1791), nonconformist minister; writer on morals, politics and economics] - "not content with the honourable Distinction of being the Great Prophet of the Age, the Doctor means by and by, to set up an exclusive Right to Fame"; probable failure of government to subdue America by Acts of Parliament - "the subjugating system is at last it seems to be pared down, or rather close shaved; our Friend is ordered to perform the Operation" [A reference to Charles Watson-Wentworth, 2nd Marquis of Rockingham who formed an administration in March, 1702; he was regarded as being a supporter of American independence]; has little faith in government to prevent further decline of the country; recommends Secker's [Thomas Secker (1693 - 1768), )Archbishop of Canterbury] sermons in contrast to "the quaint Criticisms and barbarous Latinising of that pompous Pedant Johnson", Isle of Man, 7 April 1782 Personal financial problems and the lack of unanimity among the old Whigs, Isle of Man, 14 March 1783 Congratulations on Lee's appointment as Attorney-General, Isle of Man, 24 November 1783 Believes Lee and his colleagues will regain office, Isle of Man, 3 January 1784 Little prospect for his sons' advancement - "there is no coming at anything but through the minister and his humble servant the Duke" [A reference to William Pitt, then Prime Minister, and Francis Osborne, 5th Duke of Leeds, then Foreign Secretary]; illness of Dr. Price and possible effects of Burke's book [Reflections on the French Revolution (1790)] - "The veil of compassion, humanity and moderation which this profess'd enemy and real friend to despotism has thought proper to assume seems to have blinded himself, and may for aught I know, blind others also, but the artificial covering is of too slight a texture to last long and will hardly be found sufficient to preserve the ancient lustre of Mr. Burke's favourite ornaments - Mitres, Coronets and Crowns"; has sent for Dr. Priestley's answer [Joseph Priestley (1733 - 1804), theologian and scientist; supporter of the French Revolution] to Burke - "Paine's [Rights of Man (1790), a reply to Burke's Reflections] is not without merit, tho' by no means a capital performance", Newtown, 30 April 1791

First Lord of the Treasury, 1770 - 1782] - "in order to Authenticate their Intelligance and not give too easy credit to reports", and also to state their objections; North's second answer - "contains an explicit Avowal of the Design"; opposition must be early to be effectual; plans for a meeting of those concerned in London in middle of November; [Circular letter, but signed by Rockingham], London, 30 October 1773 Letter to Lord North from the Duke of Devonshire and others (copy, enclosure in above); rumours of a proposed Land Tax to affect property of absentee English landowners in Ireland; as owners of land in both Kingdoms with ordinary Residence in England - "we have not hitherto considered such Residence as an Act of Delinquency to be punished, or as a Political Evil to be corrected by the penal Operation of a partial Tax"; do not regard their Residence in Great Britain to be in the least prejudicial to the interest of Ireland; consider the scheme to be highly injurious to both Kingdoms, London, 16 October 1773 Letter to the Duke of Devonshire from Lord North (copy, enclosure in D/Bo/C 135); cannot reply before he has communicated the contents to others of His Majesty's servants; asks Duke to excuse the delay, Bushy Park, 18 October 1773 Was sorry to have missed Lee when he called the day before; desires and insists upon calling upon Lee, London, 2 March 1780 Hopes it is possible for Lee to call that day; has just been with the Duke of Richmond and hears that - "a very perplexing scene is too probable to arise" [A possible reference to the expected trouble (known as the Gordon Riots) which began on 2 June], London, 31 May 1780 Lee will find many of their friends in good spirits at York after defeat of attempt - "to procure a most servile and deceitful Address"; hopes the Business is not to be agitated at the Assizes and prefers the idea of a general meeting of the County; some will admire Resolutions of sub- committee at Westminster [In May 1780 the Westminster sub-comittee declared themselves in favour of adult male suffrage, separation of the executive and legislature, and annual election to parliament by parishes] but hopes their friends in Yorkshire will think they have had - "a very honourable Funeral"; prefers the resolutions of the Devonshire Committee, London, 26 July 1780 Admiral Keppel is staying longer than he proposed; tells Lee this in the hope that they might have his company early in September; Keppel has not brought any fresh news from London although much is expected to arrive; none of it will probably - "ameliorate the state into which this Country is brought", Wentworth, 1 August 1781 Dinner invitation to Lee, London, 14 November, n.d.
