Reciting:
- conveyance of 27 November 1918 between (i) Walter Fell Pease, (ii) Rev John George Holburn, William Rymer Wooler, John Benton Ord, Thomas Todd and George Herbert Watson in which scheduled property inter alia was conveyed to (ii) as Joint tenants;
- death of Thomas Todd on 6 November 1920;
- death of John George Holburn on 23 September 1921;
- indenture of 29 June 1922 between (i) William Rymer Wooler, John Benton Ord and George Herbert Watson and (ii) Rev Stephen Frederick Warth, William Rymer Wooler, John Benton Ord and Herbert William Todd, Rev Albert Edward Dearden in which scheduled property was conveyed to (ii);
- death of Albert Edward Dearden on 10 January 1929;
- (2) wished to vest scheduled property with mission hall and other buildings on it by (3) to (4);
- (4) consented;
- scheduled property in conveyance of 27 November 1918 was acquired as site for a mission hall of St Matthew, Darlington, (2) having no beneficial interest in it and it was apprehended that title may be void as it was not executed by (1) in the presence of two witnesses and enrolled in accordance with provisions of Mortmain & Charitable Used Act 1888 and (1) agreed to join in the current deed
