In respect of the fixed rents payable under mineral leases a certain quantity of coal could be wrought at such a price per unit of weight as would yield that fixed rent. Additional quantities could be wrought and would be charged at the same price per unit of weight. The provisions of the individual leases vary in respect of offsetting the possible deficiency of one year's output to the quantity required to make up the fixed rental against the overplus of a later year.

(3) Sir Charles Knightley of Fawsley Park, Northampton, Bart. and Michael Bruce of Upper Brook Street, Middlesex, Esquire Covenant of (1) and (2) with (3), upon the death of Charles Smythye and failure of his male issue, for the settlement of (1)'s moiety of the premises to be purchased with the sale proceeds of leasehold collieries etc. in the parish of Lanchester held under renewable lease from the Bishops of Durham, to be sold pursuant to the trusts declared by the within recited settlement of 15 August 1785, to such uses as (1) and (2) shall jointly appoint and, subject thereto, to the use of (2) for life, thence to the use of (1) if she survive (2) and her heirs and assigns for ever and otherwise to such uses as (1) shall appoint.
